Overview

Faraday&Future Inc. and its related companies (“FF”, or “we”, or “us”) cares about your privacy and recognizes the importance of protecting your personal information. This Privacy Policy (“Policy”) describes the policies and procedures regarding information we may collect from our customers and users via this website, our app or other digital properties (collectively, the “Site”), or when you interact with us otherwise offline (e.g., when you provide your information to an FF representative over the phone) and from third-party sources. The Policy also refers to personal information that may have been collected in the 12 months preceding the date of this Policy.

By providing information to us or by using our products or services, including the Site, you agree to our collection, use and sharing of your information as described in this Policy. This Policy should be read in conjunction with the terms of use for the applicable product, including but not limited to the FF website Terms of Use and Mobile App End User License Agreement (“EULA”). 


“Personal information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household including but not limited to your name, email address, telephone numbers, your photograph should you choose to provide it, or other identifiable images provided through user-generated content (e.g. photos or videos uploaded through our app, which pursuant to our Terms of Use and EULA are your photos and videos, provided with the consent of any other parties that may be in an image). Aggregated data, de-identified data, and other information that is related to you but is studied as a group or does not otherwise identify you specifically (such as information collected through cookies, pixel tags and other technologies) is not considered to be personal information.


Personal Information We May Collect

We may collect information about you in a variety of ways. This information may include:

  • Personal Information You Give Us: We may collect your personal information directly from you both online and offline, including your name, mailing address, email address, phone number, professional or employment-related information, educational information, commercial information including products or services purchased or considered or other purchasing or consuming histories or tendencies, as well as any other information that you provide to us directly. You may provide information to us online when you submit a form to sign up for a service or to request information through the Site. When you sign up for an account with FF or make a pre-order, we may also collect personal information from you directly. We may also collect your personal information from offline sources, such as when you provide your information to an FF representative over the phone or in person. When you pre-order a vehicle, we may also collect additional information from you, including billing information. We may combine the information collected from you online and offline.
  • Online Identifiers and Other Information Collected From Your Browser or Device: When you visit our Site, we may automatically collect information from your browser or device, such as your IP address, computer operating system type, screen resolution, browser type, browser language, internet or other network activity information such as browser and search history and your interactions with our Site.
  • Information Collected From Third Party Sources: We may also collect information from or about you from other third-party sources, such as a social media platform where you have an account, or from market segmentation service providers such as Experian. This includes, but is not limited to, instances in which you affirmatively authorize third parties to provide us with information. Information collected from third-party sources may include both personal information and information that is not personally identifiable to you, as well as inferences drawn from any of the information identified in this privacy policy.
  • Audio and Visual Information: We may collect audio and visual information, including information uploaded to our app. While uploading videos to our app, a user’s microphone will need to be enabled. 
  • Location Data: We may also collect precise or approximate location data from a user’s mobile device while using our app if enabled by the user to do so. FF may collect this data while the app is running in the foreground (app open and on-screen) or in the background (app open but not on-screen). App users may use FF’s app without enabling FF to collect location data, but it may impact the functionality of the app. In addition, should users connect their vehicle to the FF app, we may collect precise or approximate location data from a user’s mobile device based on a FF vehicle location. 

How We May Use Your Personal Information 

We may use your personal information to maintain your account, personalize your experience on the Site, process your requests, and provide you with the Site and fulfill your pre-orders you’ve placed for FF products, services, or events. We may also use personal information to contact you regarding your account or your pre-orders, to fulfill your requests for information or services (including requests to receive our newsletter and other promotional materials), or to solicit feedback about a product, service, or event. We may also use your information to manage our business, including performing accounting, auditing and other internal functions. We may also use your personal information to evaluate and improve our products and services (including our Site), conduct research and perform analysis, learn more about our users and customers and identify new customers, and enhance the customer experience. 


We may use or share collected information in a variety of ways, including:

  • Using Your Information to Provide You with Services: We may use your information to maintain your account, process your requests, provide you with customer service, provide you with the Site and fulfill your pre-orders you’ve placed for FF products, services, or events, or to evaluate your application or support your employment relationship with us. 
  • Using Your Information to Contact You and Send You Promotional Materials: We may use your information to contact you regarding your account or your pre-orders. We may also use your information to fulfill your requests for information or services, including requests to receive our newsletter and other promotional materials. Promotional materials may include information regarding FF contests, events, products and services. Promotional materials may be communicated in emails, phone calls, text messages, or mailings. Should you no longer wish to receive these communications, you may opt out as described below. We may also contact you to ask for your feedback about a product, service, or event.
  • Using Your Information to Manage Our Business and Improve Our Products and Services: We may use your information to manage our business, including performing accounting, auditing and other internal functions. We may also use your information to evaluate and improve our products and services (including our Site), conduct research and perform analysis, learn more about our users and customers and identify new customers, and enhance the customer experience (including to better optimize and target our marketing and services). As described above, we may collect information using cookies, tracking tools, and analytic tools. We may use your information to personalize your experience on the Site and to improve the security, design, and functionality of our Site.
  • Sharing Your Information With Vendors: We may share your information with vendors working on our behalf, such as call center operators, servicers, dealers, marketing providers, people who analyze data for us, and other service providers.
  • Sharing Your Information With Our Selected Partners: We may share your information with our selected partners in order to conduct business. For example, we may share your information with selected partners to conduct audits or industry analysis. Similarly, we may share your information with selected partners to securely manage data and to provide you with requested information, such as email newsletters. We may also share information with our selected partners for joint marketing purposes; however, we do not share your personal information with our selected partners for their own marketing purposes without your consent.
  • Sharing Your Information With Other Third Parties: We may also share your information with third parties in other circumstances, including but not limited to the following:
    • Sharing information with third-party vendors that assist us in providing goods and services to you, or supporting your employment relationship with us.
    • Sharing your information with others for purposes of conversion tracking.
    • Sharing your information for purposes of targeted advertising on sites and platforms that you visit.
    • With your consent, including to share your information with others for their own use of marketing. Such use will be subject to their own privacy policies, which will be indicated to you when you give such consent.
    • Sharing your information when conducting a business deal (for example, a merger or acquisition, financing, sale of assets, transition of service to another provider, insolvency, or a bankruptcy transaction or proceeding) which requires the sale or transfer of all or part of our business or assets.
    • To enforce the FF website Terms of Use and other applicable terms of use.
    • To report to credit bureaus if applicable.
    • To identify, contract or bring legal action regarding injury or interference with our rights and property, including to enforce our rights against unauthorized access or attempted unauthorized access to our information technology assets or against other inappropriate use of our products and services, including the Site.
    • Sharing your information for safety purposes, including to respond to an emergency.
    • To protect the rights, property, safety and security of you and others.
    • To comply with laws, regulations, court orders and subpoenas or similar requests for information by authorities, or as otherwise required by law.
    • To assist us in fraud, security or technical issues prevention or investigation or otherwise manage risks.
  • Sharing Other Information with Third Parties: We may share non-personally identifiable information (such as aggregate usage statistics of our Site) with third parties for any number of reasons, including advertising, promotional, or other purposes.

Cookies and Analytics 

Cookies are small, sometimes encrypted data files stored on your device by a website. They are used to help users navigate websites efficiently as well as to provide information to the owner of the websites. When you visit our Site, we may place a “cookie” or other online tracking device (e.g. pixel tags) that recognizes you. Pixel tags and similar tools may also be used in our emails to track whether an email has been read or forwarded to someone else. We and our third-party vendors may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your device until you delete them) to make your experience on our Site more personal and interactive. We may use information stored in such text files and images to customize your experience on this website and to monitor use of this website. If you do not wish to have your information collected by using cookies, you can disable cookies (or specific cookies) by adjusting your browser settings. Note that if you remove or reject our cookies, it may affect how our Site works for you. Many browsers are set to accept cookies until you change your settings.

We work with third-party analytics service providers, including but not limited to Google Analytics, to help us better understand how you use our Site. For example, we use Google Analytics to learn more about the types of users that visit our Site and to help improve our Site. Google Analytics provides us with certain data regarding the demographics of the users that visit our Site. To provide this service, Google Analytics may collect certain information about you from your computer, including but not limited to: information regarding your visit (such as the pages you visit and the length of your visit), information about your device (such as your IP address), how you got to our Site, information regarding where you saw our online advertisements and which advertisements you clicked on, and other information about you. We also use Google Analytics Advertising Features for marketing purposes, including Remarketing with Google Analytics, which allow us to display promotional advertisements regarding FF to you on other sites you visit across the Internet. You can opt-out of your data being used by Google Analytics Advertising Features via Google’s Ads Settings page, available at http://www.google.com/settings/ads/onweb/, Ad Settings for mobile apps, or any other available means (e.g., the NAI’s consumer opt-out, available at http://www.networkadvertising.org/choices). Because these opt-out pages are specific to the individual browser, and because these pages are not operated by FF, we are unable to perform the opt-outs on your behalf.


Personal Information of Minors

Our products and services are not directed to minors under the age of 13. We do not knowingly collect or sell the Personal Information of minors under the age of 16. 


Data Security

We implement and maintain reasonable security appropriate to the nature of the personal information that we collect, use, retain, transfer or otherwise process. Our procedures are maintained in accordance with applicable law and relevant standards. However, data security incidents and breaches can occur due to vulnerabilities, criminal exploits or other factors that cannot always be prevented. 


Choices About Your Information; Updating Your Information

As indicated throughout this Policy, you have options to control how your information is used, including:

  • Opting-Out of Communications: Our newsletters, promotional emails, and promotional text messages include instructions for opting out of receiving further communications. You may also opt out of marketing communications by contacting us via the “Contact Information” section below. Please note that even if you opt out of receiving marketing communications, we may still communicate with you regarding non-marketing-related matters, such as our business dealings with you, notifications and information relating to your account, and other transactional messages.
  • Updating Your Personal Information or Cancelling an Account With FF: If you have signed up for an account with FF, you may review and update the personal information associated with your account by signing in to your My Account dashboard. You may also cancel your account at any time by contacting us at product@faradayfuture.com. We may ask you to verify your identity and to provide other details before we cancel your account or delete any information. Your right to delete information is subject to our record retention policy, including any retention requirements under applicable laws.

Do Not Track 

When you visit our Site, we may collect information about your online activities over time and across third-party websites or online services, including through use of third-party analytics service providers. Certain web browsers may provide an option by which you may ask your browser to inform websites you visit that you do not wish your activities to be tracked by cookies or other persistent identifiers, commonly called “Do Not Track Signals.” Our Site currently does not change its tracking practices in response to the Do Not Track Signals from your browser.


State Privacy Rights

As certain state privacy laws come into effect, you may have certain privacy rights governed by these laws. For example, you may have the right to request and receive certain information about our disclosure of your personal information to third parties for their direct marketing purposes, and your choices with respect to such disclosures. It is our policy not to share your personal information with third parties for their own direct marketing purposes unless you are first given the opportunity to opt out from such sharing.

Your Right To Request Disclosure of Information We Collect and Share About You

We are committed to ensuring that you know what Personal Information we collect. To that end, you can ask us for any or all of following types of information regarding the Personal Information we have collected about you in the 12 months prior to our receipt of your request:

  • Specific pieces of Personal Information we have collected about you; 
  • Categories of Personal Information we have collected about you; 
  • Categories of sources from which such Personal Information was collected; 
  • Categories of Personal Information we sold or disclosed for a business purpose about you; and 
  • The business or commercial purpose for collecting or selling your Personal Information.

Your Right To Request Deletion of Personal Information We Have Collected About You 

Upon your request, we will delete the Personal Information we have collected about you, except for situations where we are authorized under the law to retain specific information, including when it is necessary for us to provide you with a good or service that you requested; perform a contract we entered into with you; maintain the functionality or security of our systems; or comply with or exercise rights provided by the law. The law also permits us to retain specific information for our exclusively internal use, but only in ways that are compatible with the context in which you provided the information to us or that are reasonably aligned with your expectations based on your relationship with us. We will act on your deletion request within the timeframes set forth below.

Sale of Personal Information

While we engage in personalized advertising and use third-party advertising networks to support our marketing efforts as more specifically described in our Cookies section above, we do not otherwise engage in activities that would constitute a “sale” of the personal information of our customers. California Shine the Light

California Civil Code Section 1798.83, also known as the “Shine the Light” law, permits California residents to annually request, free of charge, information about certain categories of Personal Information a business has disclosed to third parties for direct marketing purposes in the preceding calendar year. We do not share Personal Information of California residents with third parties for their own marketing purposes.


Exercising Your Rights and How We Will Respond

For requests for access or deletion, we will first acknowledge receipt of your request within 10 business days of receipt of your request. We provide a substantive response to your request as soon as we can, generally within 45 days from when we receive your request, although we may be allowed to take longer to process your request under certain circumstances. If we expect your request is going to take us longer than normal to fulfill, we will let you know.

While we engage in personalized advertising and use third-party advertising networks to support our marketing efforts as more specifically described in our Cookies section above, we do not otherwise engage in activities that would constitute a “sale” of the personal information of our customers. We usually act on requests and provide information free of charge, but we may charge a reasonable fee to cover our administrative costs of providing the information in certain situations. In some cases, the law may allow us to refuse to act on certain requests. When this is the case, we will endeavor to provide you with an explanation as to why. 


Our Commitment to Honoring Your Rights

If you exercise any of the rights explained in this Notice, we will continue to treat you fairly. If you exercise your rights under this Notice, you will not be denied or charged different prices or rates for goods or services, or provided a different level or quality of goods or services than others.


Verification of Identity – Access or Deletion Requests

We will ask you for identifying information and attempt to match it to information that we maintain about you. 

If we are unable to verify your identity with the degree of certainty required, we will not be able to respond to the request. We will notify you to explain the basis of the denial. 


Ensuring Veracity of Opt-Out Requests

If we have a good-faith, reasonable belief that a request to opt-out of the sale of Personal Information is fraudulent, we may deny the request. Should this occur, we will inform you and explain why we believe the request is fraudulent. 


Authorized Agents

You may designate an agent to submit requests on your behalf. For example, the agent may be required to be a natural person or a business entity that is registered with the California Secretary of State or other state agency. 

If you would like to designate an agent to act on your behalf, you and the agent will need to comply with our agent verification process. You will be required to verify your identity by providing us with certain Personal Information as described above, depending on whether you hold an account with us or not and the nature of the information your require, which we will endeavour to match the information submitted to information we maintain about you. Additionally, we will require that you provide us with written confirmation that you have authorized the agent to act on your behalf. The agent will be required to provide us with proof of the agent’s identity and status as an agent, under penalty of perjury. Information to identify and verify your agent can be submitted through our verification portal.

Please note that this subsection does not apply when an agent is authorized to act on your behalf pursuant to a valid power of attorney.

Requests for Household Information

There may be some types of Personal Information that can be associated with a household (a group of people living together in a single dwelling). Requests for access or deletion of household Personal Information must be made by each member of the household. We will verify the identity of each member of the household using the verification criteria explained above and will also verify that each household member is currently a member of the household. 

If we are unable to verify the identity of each household member with the degree of certainty required, we will not be able to respond to the request. We will notify you to explain the basis of our denial. 


Exclusions

Unless otherwise specified, our Site is intended for use within the U.S. Accordingly, if you do not reside in the U.S. and are using our Site, if you provide personal information to us, it may be transferred to and processed on computers in the U.S. and other countries. The data protection and privacy laws of such other countries, including the U.S., may not afford you the same level of protection as those in your own country. Do not provide your personal information to us if you do not want this information to be transferred outside of your country, or if the laws in your country restrict these types of transfers. Your provision of personal information to us will be handled in accordance with this Policy. By doing business or interacting with FF, by using our Site, or by otherwise providing personal information to us, you agree to the terms of this Policy and are consenting to the transfer, storage, and processing of your personal information to and within facilities located in the U.S. and other facility locations selected by FF. 

This Policy addresses FF’s procedures for handling the personal information of customers in the U.S. who are at least 13 years old. We do not seek to, nor do we knowingly collect, information from children. If a child has provided us with personal information, a parent or guardian of that child may contact us to have the information deleted from our records. To do so, contact FF through the information provided below.


Other Websites and Social Media Buttons

Our Site may contain links to other websites or social media buttons. We are not responsible for the privacy practices or the content of those websites or social media platforms. This Privacy Policy applies only to our business and the personal information we collect. All financial transactions on our Site are securely processed through Chase Paymentech using Secure Socket Layer (SSL) encryption. We do not store any credit card or bank information from such transactions on our servers. Changes to This Policy

We will review and update this Policy as required to keep current with rules and regulations, new technologies and security standards. FF reserves the right to revise this Policy at our discretion. We will post those changes on the website or update the “last updated” date of the Privacy Policy. In certain cases and if the changes are significant, we may notify you of the changes in a more prominent way, such as through an email or notice on our website. Your inaction or continued use of our Site, products or services after the revised Policy is posted will tell us that you agree to these changes.
